The Government Information (Public Access) Act 2009 (NSW) (GIPA Act)

ACCESSING INFORMATION HELD BY SOUTH WESTERN SYDNEY LOCAL HEALTH DISTRICT

There are four ways in which information held by South Western Sydney Local Health District (SWSLHD) will be available:

  1. Mandatory release:

The following information is routinely updated (as required) and is available for review:

  • The South Western Sydney Local Health District website: You can search the website at https://www.swslhd.health.nsw.gov.au/ for information about SWSLHD, its facilities and services, recruitment and training, as well as a list of the SWSLHD's publications, resources and policy documents.
  • The Agency Information Guide: The Agency Information Guide provides an overview of the functions of SWSLHD.
  • The GIPAA Disclosure Log: The Disclosure Log lists all formal determinations made by SWSLHD under GIPAA. Access to the document can be provided by contacting the District Right to Information Coordinator.

The disclosure log does not include:

    • information on applications for personal information regarding the applicant, or
    • information about applications where factors involving the applicant were a consideration in whether or not the disclosure of the information was in the public interest
  • Information tabled in Parliament: Information about SWSLHD contained in any document tabled in Parliament by or on behalf of the agency is available here.
  • Record of information not made publicly available: Information which was formally requested under GIPAA, but which SWSLHD did not make publicly available on the basis of an overriding public interest against disclosure is listed here.
  1. Proactive release:

You are welcome to ask SWSLHD what information it will make available to the public, in addition to the information contained on its website. Under GIPAA, SWSLHD will release as much information as possible, in an appropriate way and free of charge (or at the lowest reasonable cost). The Right to Information Unit can be contacted on (02) 8738 5720.

  1. Informal request:

You are welcome to request specific information from SWSLHD.  SWSLHD is able to consider requests for information without the need for a formal application unless there are possible public interest reasons why it should not be released.

If you think this applies to the information you wish to access, you can contact the Right to Information Unit to discuss via telephone (02) 8738 5720 or via email SWSLHD-PrivacyGIPA@health.nsw.gov.au .  You may be asked to provide details of your request in writing.

Under the GIPA Act, Government agencies are not required to release information without an access application. The SWSLHD reserves the right to require an applicant to lodge an access application if:

  • there are significant public interest considerations to be taken into account
  • you are seeking access to a large volume of information
  • it would take the Department a significant amount of time to consider your request
  1. Formal application:

If you haven't been able to get the information you want through the above 3 methods, you can formally request specific information from SWSLHD.
